These Terms and Conditions govern the sale of vintage Austin Pedal cars and related parts sold by Driven By Vintage, 17 Douglas Cl, Jacobs Well, Guildford GU4 7PB(we, us, our) to the customer (you, your). Our VAT number is GB 426 5012 85
1.1 Order Acceptance
All orders placed by you for vintage Austin pedal cars and parts (whether through our website, by telephone, email, or in person) are subject to these Terms and Conditions and to our acceptance. A legally binding contract is formed between us when we:
(i) confirm your order in writing (by email or order confirmation); or
(ii) dispatch the goods to you; or
(iii) hand over the goods to you at collection, whichever occurs first.
We reserve the right to decline any order at our discretion, particularly where we cannot verify authenticity, the item is no longer available, or payment cannot be verified.
1.2 Payment Processing
Payment processing and receipt of an order confirmation does not automatically constitute acceptance of your order. We reserve the right to cancel orders (with a full refund) if:
(i) the item is no longer available;
(ii) there are discrepancies in the item’s condition or authenticity;
(iii) payment cannot be verified; or
(iv) we are unable to fulfill the order for any other reason.
You will be notified promptly if we cannot accept your order.
2. Ordering
2.1 Placing Orders
You may place an order through our website by selecting the item you wish to purchase and following the checkout process. You will have the opportunity to review and correct any details (including delivery address and payment information) before finalizing your order by clicking “Place Order” or similar button.

2.2 Order Acceptance
All orders are subject to acceptance by us as described in clause 1.1. We reserve the right to decline any order without liability, including (but not limited to) where:
(i) the item is no longer available or has been reserved by another customer;
(ii) we identify any concerns regarding the item’s condition or authenticity;
(iii) we cannot verify payment or delivery details;
(iv) pricing or product information was displayed incorrectly due to an error; or
(v) we suspect fraudulent activity.
If we cannot accept your order, we will notify you promptly and provide a full refund of any payment received.
2.3 Product Conformity
Where we accept your order, we have a legal duty to supply goods that:
(i) match the description provided in the listing;
(ii) are of satisfactory quality given their vintage/used nature; and
(iii) conform to these Terms and Conditions.
Please note: As vintage and restored items, products are sold based on the condition description provided at the time of listing. Minor variations in appearance from photographs are normal for items of this age and nature.
3. Price And Payment
3.1 Pricing
The price payable for goods is as displayed on our website at the time you place your order, plus any delivery charges as shown during checkout. All prices are in pounds sterling (GBP) and include VAT at the current rate where applicable.
3.2 Price Accuracy
While we make every effort to ensure pricing accuracy, errors may occasionally occur. If an item is incorrectly priced, we will:
(i) contact you as soon as possible to inform you of the error;
(ii) give you the option to proceed at the correct price or cancel your order; and
(iii) provide a full refund if you choose to cancel or if we cannot reach you.
We reserve the right to cancel orders where pricing errors are significant or obvious (e.g., a £5,000 pedal car listed at £50).
3.3 Price Changes
Prices on our website may change at any time. You will be charged the price displayed at the time you submit your order, provided we accept it. Once an order is accepted and paid for, the price will not change.
3.4 Payment Terms
We must receive payment for the whole of the price of the goods you order and purchase, and any applicable charges for delivery, before your order can be processed unless we have agreed otherwise in advance in writing.
3.5 Payment Security
We accept payment by bank transfer only. Bank details will be provided in your order confirmation email.
When making payment, please include your order number as the payment reference to ensure we can match your payment to your order promptly.
We are not responsible for any losses incurred from errors in bank details or payments sent to incorrect accounts. Always verify bank details by contacting us directly if you have any doubts.
3.6 Set-Off Rights
We reserve the right to set off any amounts you owe us against any amounts we may owe you.
3.7 Invoices
We will provide an invoice for your purchase. The format and content of invoices is at our discretion.
4. Delivery & Title
4.1 Delivery Times
We aim to dispatch your order within 5 working days of receiving cleared payment, unless otherwise agreed in writing. We handle all deliveries ourselves to ensure your vintage pedal car or parts arrive safely.
We will provide tracking information and estimated delivery date once your order has been dispatched. In exceptional circumstances, delivery may be delayed.
4.2 Delivery Options & Address
Delivery costs are shown during checkout. Please ensure:
(i) you provide a complete and accurate delivery address;
(ii) someone aged 18 or over is available to receive the delivery and provide a signature; and
(iii) the delivery location is accessible for our delivery vehicle.
If you have not received your order within the expected timeframe, please contact us immediately at returns@drivenbyvintage.com.
4.3 Inspection Upon Delivery
Given the vintage nature of our products, we strongly recommend that you:
(i) inspect the goods immediately upon delivery for any transit damage;
(ii) sign for delivery as “unchecked” if you cannot inspect immediately; and
(iii) notify us within 48 hours of any damage or discrepancies.
Do not dispose of packaging until you have fully inspected the item.
4.4 Failed or Delayed Delivery
You must take reasonable steps to accept delivery at the agreed time and place. If delivery fails due to:
(i) no one being available to receive the goods;
(ii) incorrect address provided; or
(iii) refusal to accept delivery;
we will attempt to arrange re-delivery within 30 days. Any re-delivery costs will be charged to you. If re-delivery cannot be arranged, we may cancel your order and refund the purchase price minus delivery costs incurred.
4.5 Risk & Title
Risk in the goods (i.e., responsibility for loss or damage) passes to you upon delivery to your address.
However, ownership (title) of the goods remains with us until we have received full payment. Until payment is received in full:
(i) you must store the goods safely and separately from other items;
(ii) you must not sell, dispose of, or modify the goods;
(iii) we may require you to return the goods to us; and
(iv) we reserve the right to enter your premises to inspect or recover the goods.
4.6 Delivery Costs
All delivery costs are payable by you and are shown during checkout. Costs vary depending on:
(i) item size and weight;
(ii) delivery location; and
(iii) special handling requirements for large or delicate items.
Delivery costs are non-refundable except where goods are faulty or we have made an error.
5. Availability
All goods are subject to availability. As we sell vintage and one-of-a-kind items, stock cannot always be guaranteed. If an item you have ordered becomes unavailable, we will contact you immediately to discuss a refund or alternative options.
6. Cancellation, Returns & Refunds
6.1 Your Right to Cancel

6.2 How to Return Items
Before returning any item, you must:
(i) contact us to obtain a Return Authorization (RMA) number;
(ii) return the item in its original condition with all packaging, components, and accessories;
(iii) send the item via a tracked and insured courier service at your own cost; and
(iv) include your order number, RMA number, and reason for return.
Items must be returned within 30 days of notifying us of your cancellation.
6.3 Condition of Returned Items
Items must be returned:
(i) unused and in the same condition as received;
(ii) with original packaging intact; and
(iii) with all accessories, parts, and documentation included.
We reserve the right to deduct from your refund if items show signs of use beyond what is necessary to inspect them (e.g., scratches, modifications, missing parts).
6.4 Refunds
Once we receive and inspect your returned item, we will process your refund within 30 days using your original payment method.
If you cancel the entire order, we will refund the full purchase price plus standard delivery charges. If you cancel part of an order, delivery charges are non-refundable.
6.5 Items That Cannot Be Returned
You cannot cancel or return:
(i) custom-made, modified, or personalized items;
(ii) items made to your specifications; or
(iii) items that have been opened or used (unless faulty).
6.6 Faulty or Damaged Items
If you receive a faulty or damaged item, contact us within 48 hours of delivery. We will:
(i) arrange collection at our cost;
(ii) repair, replace, or refund the item at our discretion; and
(iii) cover all return delivery costs.
Your right to return faulty goods is not limited to the 30-day cancellation period.
6.7 Items Damaged After Delivery
If an item develops a fault after the initial inspection period, contact us to discuss repair or replacement options. We will assess each case individually based on the nature of the fault and age of the item.
6.8 Your Legal Rights
Nothing in these terms affects your statutory rights as a consumer under UK law.
7. Liability
7.1 Consumer Purchases
If you are buying as a consumer (not for business purposes), we are not liable for:
(i) loss that was not foreseeable when you placed your order;
(ii) loss that occurs when we are not at fault or in breach of these terms; or
(iii) business losses (including loss of profits, contracts, or business opportunities).
7.2 Product Description
All items are described accurately based on their condition at the time of listing. As vintage items, minor variations in appearance from photographs are normal and do not constitute a breach of contract.
7.3 Limitation of Liability
Nothing in these terms excludes or limits our liability for:
(i) death or personal injury caused by our negligence;
(ii) fraud or fraudulent misrepresentation; or
(iii) any other liability that cannot be excluded by law.
7.4 Your Statutory Rights
Nothing in these terms affects your legal rights as a consumer under UK law.
8. Suspension or Termination
We may suspend or cancel your order and stop delivery if:
(i) you fail to make payment when due;
(ii) you provide false or fraudulent information;
(iii) you breach these terms and conditions; or
(iv) you become insolvent or unable to pay your debts.
If we terminate your order, any outstanding payments become immediately due.
9. Events Beyond Our Control
We are not liable for delays or failures in delivery caused by events beyond our reasonable control, including:
(i) extreme weather, natural disasters, or acts of God;
(ii) strikes, industrial action, or transport disruptions;
(iii) terrorist attacks, war, or civil unrest;
(iv) government restrictions or regulations; or
(v) failure of utilities, telecommunications, or transport networks.
If such an event occurs, we will contact you as soon as possible to discuss alternative arrangements or a refund.
10. General
10.1 Severability
If any part of these terms and conditions is found to be invalid or unenforceable, the remaining provisions will continue to apply in full.
10.2 Governing Law
These terms and conditions are governed by English law. Any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.
10.3 Changes to Terms
We reserve the right to update these terms and conditions at any time. The latest version will always be available on our website. Your continued use of our website and services constitutes acceptance of any changes.
